ORDINANCE AMENDING THE OFFENSES AGAINST PUBLIC MORALS REGARDING PUBLIC URINATION AND DEFICATION WITHIN THE CITY OF FARMER CITY
WHEREAS, the City of Farmer City is an Illinois municipal corporation, organized and operating pursuant to the Illinois Municipal Code, 65 ILCS 5/1-1-1 et seq.; and
WHEREAS, Chapter 134 of the Code of Ordinances of the City of Farmer City, Illinois establishes a criminal code, Offenses Against Public Morals;
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Farmer City, DeWitt County, Illinois that:
Section 1. The following section 134.04 shall be added to the Code of Farmer City, Illinois
- 134.04 PUBLIC URINATION AND DEFICATION PROHIBITED
No person shall urinate or defecate on any street, alley, sidewalk, parking lot, floor of any public building, any building where the public gathers, a public or private location where such act is visible to members of the public, or in any other place commonly open to the public except in such public place that has been specifically designated as a restroom.
- Definition: For the purpose of this section, the term “Public” shall mean any place where the conduct may reasonably be expected to be viewed by others.
- Definition: For the purpose of this section, the term “Urination” shall mean the discharge of urine from the human body.
- Definition: For the purpose of this section, the term “Defecation” shall mean the excrement of human fecal matter.
- Prohibition Use: The discharge of human urine and / or fecal matter by any person on public property, or any public or private property where such act is visible to others.
- Affirmative Defense: None
- Penalty: Upon conviction of a violation of this section, the court shall impose upon the violator a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) per offense.
Section 2. This ordinance shall take effect upon passage.
Section 3. If any section, subdivision or provision of this ordinance is held invalid or to be unenforceable, such invalidity or unenforceability shall not affect the validity of the remaining portion of this ordinance, or provisions of the code.
Section 4. The provisions of this ordinance shall take precedence and be interpreted as superseding any other ordinance or stature in conflict with provisions of this code.
Section 5. The city clerk is hereby directed to publish this ordinance immediately after passage.
