ORDINANCE AMENDING CODE REGARDING THE KEEPING OF ANIMALS OTHER THAN DOMESTICATED PETS WITHIN THE CITY OF FARMER CITY
WHEREAS, the City of Farmer City is an Illinois municipal corporation, organized and operating pursuant to the laws and constitution of the State of Illinois; and
WHEREAS, 510 ILCS 5 Animal Control Act Section 5 allows municipalities to further control and regulate dogs, cats and other animals:
NOW THEREFORE BE IT ORDAINED by the City Council of the City of Farmer City, DeWitt County, Illinois that:
Section 1. The following paragraphs shall be deleted from the Code of Farmer City, Illinois
§ 90.11 KEEPING ANIMALS OTHER THAN DOMESTICATED PETS.
(C) No person shall keep or maintain any fowl or poultry, or bird (except for domesticated birds kept in the home) in any residential, commercial or industrial area within the corporate limits of the city.
Section 2. The following paragraphs shall be added to the Code of Farmer City, Illinois
§ 90.11 KEEPING ANIMALS OTHER THAN DOMESTICATED PETS.
(C) No person shall keep or maintain more than 6 fowl or poultry, or birds in any residential area within the corporate limits of the city. Any fowl, poultry or birds must be contained in a pen or structure designed to confine or shelter fowl, poultry or birds within the rear yard of a residence. Domesticated birds may be kept in the home.
Section 3. If any section, subdivision or sentence of this ordinance is for any reason held invalid or to be unconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance.
Section 4. This ordinance shall be in full force and effect from and after its adoption, as provided by law.
